Adoption of the OSHA Confined Space in Construction Standard - MOSH Training and Education

On December 23, 2016, Maryland Occupational Safety & Health adopted the federal OSHA requirements for Confined Space in Construction, 29 CFR 1926 Subpart AA. These new rules became effective in Maryland on January 2, 2017.

States like Maryland operating their own OSHA program must promulgate standards which are at least as effective as the federal standards within six months of their publication in the Federal Register. Maryland has adopted the new federal rules by reference.

Repeal of the existing MOSH Confined Space in Construction Regulation

On December 23, 2016, The Commissioner of Labor and Industry repealed COMAR 09.12.35 Maryland Occupational Safety and Health Standard for Confined Spaces. This action was considered by the Maryland Occupational Safety and Health Advisory Board pursuant to a meeting held on June 17, 2015.

The purpose of this action is to repeal Maryland’s Occupational Safety and Health Standard for Confined Spaces. At the Federal level, the Occupational Safety and Health Administration has adopted new standards on confined spaces with the Standards relating to Confined Spaces in Construction, 29 CFR Part 1926.
