Maryland Lien for Unpaid Wages

 

The Maryland Lien for Unpaid Wages law became effective October 1, 2013. The Maryland Lien for Unpaid Wages law provides that an employee who has not been paid all wages due and owing may file a lien against certain property of their employer who owes the unpaid wages. The law requires that an employee notify their employer of their intent to claim a lien for unpaid wages on real and/or personal property. An employer may dispute a lien for unpaid wages by filing a complaint in the circuit court where the property is located.

The regulations implementing this law can be found in the Code of Maryland Regulations (COMAR) 09.12.39.01-.05.
