Living Wage for State Service Contracts

 
The Living Wage Law requires contractors and subcontractors to pay a Living Wage to employees performing work on certain State service contracts, in excess of $100,000 with certain exemptions.

The Living Wage Law authorizes the Commissioner of Labor and Industry to administer and enforce the law. The Commissioner of Labor and Industry is required to adjust the wage rates based on the Consumer Price Index and to allow certain reductions to the wage rates. The wage rates and any adjustments will be published on the Division of Labor and Industry's Website. Effective September 28, 2009, Living Wage rates are $12.25 per hour in Tier 1 areas and $9.21 in Tier 2 areas, depending on the on the location where the services are performed or on the location benefiting from the work. The rates change each year and are published 90 days from the end of the State fiscal year.

The Commissioner of Labor and Industry has developed a Living Wage Notice, which includes the Living Wage rate, the employee's rights, and the name, address, and telephone number of the Commissioner of Labor and Industry. The Notice is available on this website and is required to be posted in a prominent and easily accessible place at the work site.

Failure to comply with the Living Wage Law will result in the assessment of penalty damages and payment of restitution to the appropriate employees.
