Mr. William C. Taylor called the Council meeting to order at 9:02 a.m. at the Washington, D.C. Electricians JATC, I.B.E.W. Local No. 26, 4371 Parliament Place, Suite A, Lanham, Maryland 20706 and welcomed all Council members, staff and guests in attendance. He thanked the Washington, D.C. Electricians JATC for hosting the Council meeting. Mr. Sean Myers, Assistant Training Director, welcomed the Council members, staff and guests to their training facility and stated that they were welcome to stay for a tour of the training facility following the Council meeting.

I. The first order of business was the approval of the minutes of the March 8, 2016 Council meeting. The minutes of the March 8, 2016 Council meeting were approved as submitted.

II. DIRECTOR’S REPORT:

A. Ms. Sibbald reported to the Council that there was a little over $200,000 in the Maryland Apprenticeship and Training Fund. She reminded those organizations that accept money for the fund need to submit their reports for the funds that they receive.

B. Council members were informed that Senate Bill 92 that would move the Maryland Apprenticeship and Training Program out of the Division of Labor and Industry and into the Division of Workforce Development and Adult Learning had passed unanimously in the General Assembly. Representatives of the Division of Workforce Development and Adult Learning would be attending the July 12, 2016 Council meeting. There was Council discussion of the transition to the Division of Workforce Development and Adult Learning.

Mr. James Yuhase of the Ironworkers Local No. 5 Joint Apprenticeship and Training Committee invited Council members to attend their outstanding apprentice competition that would be held on Saturday, May 14, 2016 at their training facility on Old Marlboro Pike in Upper Marlboro, Maryland.

III. OLD BUSINESS:

A. PROGRAM REVISIONS:

1. Parker Fuel Company, Inc. (John Vontran) - Revision to change the related instruction to be through the Heating and Air Conditioning Contractors or Maryland, Inc.

This item was tabled at the January 12, 2016 Council meeting in order for a representative of the sponsor to be present at the Council meeting.

A motion to approve this revision was made by Mr. Shmelzer, seconded by Mr. Yeatman and unanimously approved.

IV. NEW BUSINESS:

A. PROGRAM REVSIONS:

1. Associated Builders and Contractors, Inc., Baltimore Metropolitan Chapter (Alfred M. FitzSimons) - Revision to the apprentice selection procedure and Affirmative Action Plan in regards to the minimum educational requirement.

Employer Representative Michelle L. Butt recused herself from the consideration of this item of Council business.

Mr. FitzSimons informed Council members that this revision was to allow the sponsor to accept applicants without a high school diploma or GED and to provide them with one year in which to attain one in order to continue in the apprenticeship program.

Mr. Cluster inquired as to whether those individuals would have to take an assessment of their math skills. Ms. Butt responded that they would.

Mr. Yeatman asked would happen if these individuals were not able to attain a GED within the allotted time period. Ms. Butt stated that they would not be able to continue in their apprenticeship program. She went on to state the ABC would assist them in getting into a GED program.

A motion to approve this revision was made by Mr. Cluster, seconded by Mr. Wilson and unanimously approved.

2. Bilbrough’s Electric, Inc. (John Vontran) - Revision to add Associated Builders and Contractors, Inc., Chesapeake Shores Chapter as a related instruction provider for the occupation of Electrician.

Mr. Cluster inquired about their existing related instruction providers. Ms. Ellwanger responded that they had existing related instruction providers and that where an apprentice would take their related instruction classes would depend upon where they lived. Mr. John Taylor added that the classes that they were already using in Delaware use the same curriculum as is used by Associated Builders and Contractors.

A motion to approve this revision was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.

3. International Union of Operating Engineers Local No. 99 Joint Apprenticeship Committee (John Vontran) - Request for reactivation of Standards of Apprenticeship for the Occupation of Stationary Engineer.

Mr. Vontran stated that he had found that their Standards of Apprenticeship, related instruction curriculum and schedule of on-the-job work processes remained current with industry practices.

Both Mr. Shmelzer and Mr. Yeatman wanted to know how the apprenticeship program became inactive and how long it had been inactive. Mr. Redden, their Training Coordinator, explained that it is operating and that they have accepted approximately 20 new apprentices each year since the apprenticeship program was first registered in Maryland. The reason that it has appeared to be inactive is that none of the new apprentices that they have accepted into the program since 2012 had ever been registered with the Maryland Apprenticeship and Training Council. That had happened during the time that a prior Training Coordinator had left the local and they were transitioning to a new one. During that time, the paperwork that explained the process for registering the apprentices in Maryland had been misfiled.

A motion to approve the reactivation of Standards of Apprenticeship for the International Union of Operating Engineers Local No. 99 Joint Apprenticeship Committee for the occupation of Stationary Engineer was made by Mr. Yeatman, seconded by Mr. Cavey and unanimously approved.

4. Volvo Group Trucks Operation (John Vontran) - Request for reactivation of the occupation of Machine Repairer with updated schedule of on-the-job training work processes and related instruction curriculum.

A motion to approve the reactivation of the occupation of Machine Repairer with an updated schedule of on-the-job training work processes and related instruction curriculum for Volvo Group Trucks Operation was made by Mr. Shmelzer, seconded by Mr. Yeatman and unanimously approved.

5. International Union of Elevator Constructors Local No. 10 Joint Apprenticeship Committee (Alfred M. FitzSimons) – Request for registration of revised and updated Standards of Apprenticeship and Affirmative Action Plan.

Employee Representative Robert F. Yeatman, Jr. recused himself from the consideration of this item of Council business.

A motion to approve the revised and updated Standards of Apprenticeship was made by Mr. Cluster, seconded by Mr. Wilson and unanimously approved.

A motion to approve the revised and updated Affirmative Action Plan was made by Mr. Shmelzer, seconded by Mr. Cavey and unanimously approved.

B. OTHER BUSINESS:

1. Finishing Trades Institute of Maryland, Virginia, Washington, D.C. and Vicinities (John Vontran) - Request to register an apprentice Bridge/Industrial Painter with credit for on-the-job training and related instruction beyond the fifty percent (50%) level.

A motion to approve this request was made by Mr. Cavey, seconded by Ms. Butt and unanimously approved.

2. International Union of Operating Engineers Local No. 99 Joint Apprenticeship Committee (John Vontran) - Request to register twenty-four (24) apprentice Stationary Engineers with credit for on-the-job training and related instruction beyond the fifty percent (50%) level due to delayed registration.

Mr. Vontran explained to Council members that 24 apprentices who had started in 2012 or 2013 and had never been registered have now exceeded fifty percent (50%) of the terms of their apprenticeships and now required the approval of the Council in order to be registered.

Mr. Shmelzer questioned the number of hours of training that those apprentices had accrued. Mr. Vontran responded that the number of hours of on-the-job training had come from the number of hours worked that had been reported to the pension fund and that the number of hours of related instruction completed had been compiled from sign-in sheets.

A motion to conditionally approve this request pending the receipt of further documentation of the hours of on-the-job training and related instruction completed was made by Mr. Yeatman, seconded by Mr. Shmelzer and unanimously approved.

3. Request for approval of ACDI to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to approve ACDI to be an eligible employer for Apprenticeship Maryland (Youth) pending the receipt of the signature page was made by Mr. Cluster, seconded by Mr. Shmelzer and unanimously approved.

4. Request for the approval of B. Todd Stocks Insurance Agency, LLC to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to approve the B. Todd Stocks Insurance Agency, LLC to be an eligible employer for Apprenticeship Maryland (Youth) was made by Mr. Smarte, seconded by Mr. Cavey and unanimously approved.

5. Request for the approval of the Brunswick Woodworking Company, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to table the request for approval of the Brunswick Woodworking Company, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) due to concerns as to whether minors would be permitted to perform the duties of the requested occupations was made by Mr. Shmelzer, seconded by Mr. Bromley and unanimously approved.

6. Request for the approval of Insul-Tech, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

Employee Representative Brian S. Cavey recused himself from the consideration of this item of Council business.

A motion to approve Insul-Tech, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) was made by Ms. Butt, seconded by Mr. Bromley and unanimously approved.

7. Request for O’Boyle Enterprises, Inc. T/A Custom Machine to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to table the request for approval of O’Boyle Enterprises, Inc. T/A Custom Machine to be an eligible employer for Apprenticeship Maryland (Youth) due to concerns as to whether minors would be permitted to perform the duties of a CNC Apprentice was made by Mr. Smarte, seconded by Mr. Wilson and unanimously approved.

8. Request for Phoenix Mecano, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to approve the request for Phoenix Mecano, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) for the occupations of Manufacturing Engineer and Print (Silkscreen/ Pad Print) Operator while tabling the occupation of CNC Machine Operator due to concerns as to whether minors would be permitted to perform the duties of that occupation was made by Mr. Cluster, seconded by Mr. Smarte and unanimously approved.

9. Request for RAMFP Molds Industries, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to approve the request for RAMFP Molds Industries, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) for the occupations of Manufacturing Technician and CAD/CAM Technician while tabling the occupation of CNC Machinist due to concerns as to whether minors would be permitted to perform the duties of that occupation was made by Mr. Cluster, seconded by Mr. Wilson and unanimously approved.

10. Request for Woodsboro Bank to be an eligible employer for Apprenticeship Maryland (Youth) (John Vontran).

A motion to approve the request for the Woodsboro Bank to be an eligible employer for Apprenticeship Maryland (Youth) was made by Mr. Cluster, seconded by Mr. Smarte and unanimously approved.

Mr. Wallace reported to the Council on the outcomes of the Skills USA - Maryland competitions that had been held on April 15 ant 16, 2016.

Mr. Yeatman provided the Council with an update on the Eastern Seaboard Apprenticeship Conference that he had recently attended.

There being no further business to come before the Council, the meeting of the Maryland Apprenticeship and Training Council was adjourned at 10:35 a.m.
